'J' Visa Waiver
You will find authoritative information, including the data sheet you must file, on the United States Department of State's website.
Only the data sheet at this website will be accepted by the State Department. Applications with other versions of the Data Sheet will be returned to the sender without processing.
Exchange visitors who are subject to, but do not wish to comply with, the two-year home country residence requirement, may apply for a waiver of that requirement under any one of the five applicable grounds provided by the United States immigration law. One of the applicable grounds is on the basis of a "No Objection" statement from the Australian Government.
The Embassy will provide a statement that the Australian Government has no objection to the exchange visitor not returning to the home country to satisfy the two-year foreign residence requirement of Section 212(e) of the Immigration and Nationality Act, as amended, and remaining in the US if he or she chooses to do so.
This statement must be submitted directly to the Waiver Review Division by the Embassy.
If you need such a statement, you must submit:
- a copy of your completed data sheet including the "Third Party Barcode Page";
- your waiver case file number;
- the number, place of issue and expiration date of your Australian passport;
- a cheque made payable to the Cashier, Embassy of Australia for USD113 (as at 1 June 2008); and
- a signed declaration made before and signed by a Notary Public in the following form:
I [insert full name] do solemnly and sincerely declare that I am under no obligation, financial or otherwise, to return to Australia at the completion of my exchange in the United States of America under the J Visa program.

If you make your request at the Embassy in person, you may sign the declaration before a consular official instead of a Notary Public. There is an additional fee of USD19 for this service.
The letter of "No Objection" will be sent to the US Department of State's Waiver Review Division within one business day.
