INSTRUCTIONS FOR PARTNER (SUBCLASS 309/100) & PROSPECTIVE MARRIAGE (SUBCLASS 300) APPLICATIONS
The following is a list of items to be submitted with your migration application. We strongly recommend that you submit your application using a method of trackable mail so that you can confirm the delivery of your package.
Please refer to our Frequently Asked Questions and general information about lodging your application in Washington for additional information.
Please note that due to delays in the issuance of FBI clearances, we encourage you to apply for your FBI character check as soon as possible and, if available, include the results with your initial application.
♦ Visa Application Charge. Please refer to our payment and visa fees paragraph for details on acceptable methods of payment.
♦ Form 47SP (Application for Migration to Australia). Please ensure the entire form, as applicable, is completed to the best of your ability.
♦ Form 40SP (Sponsorship for Migration to Australia).
♦ One (1) passport-type photograph of applicant, dependents who are migrating, and the sponsor. All photographs must bear the names of the persons they represent. Please note that you will need two (2) additional photographs for the medical forms.
♦ Notarised copy of passport(s) or other travel documents, valid for travel to Australia, for each person migrating. The original passport may be requested once your application is finalised.
♦ If applicable, notarised copy of marriage certificate(s). Only certificates issued by a government authority are acceptable. Do not send religious certificates. These must be provided for all previous marriages, as well as current, for both applicant and sponsor.
♦ Notarised copies of birth certificates for all members of the family migrating to Australia. These must include parents' names. Only certificates issued by a government authority are acceptable. Do not send hospital or religious certificates.
♦ Notarised copy of sponsor's birth certificate. Only certificates issued by a government authority are acceptable.
♦ If applicable, Notarised copy of sponsor’s Australian passport as well as evidence of status in the US, ie green card, visa (if applicable).
♦ If applicable, Notarised copy of evidence of sponsor's legal status in Australia, ie evidence of Australian citizenship or permanent residence.
♦ If applicable, notarised copy of any legal name change for applicants or sponsor.
♦ If applicable, notarised copy of any final divorce papers concerning all previous marriage(s) of either applicant or sponsor.
♦ A detailed statement about your relationship with the sponsor from your first meeting to the present time, including important dates and events in the development of your relationship.
♦ Notarised declarations from family and friends attesting to the nature of your relationship. Declarations from the USA should be notarised by a US Notary Public. If completed in Australia, declarations should be made on form 888 (statutory declaration).
♦ Notarised statement from your sponsor detailing how they will meet the sponsorship obligations: ie, plans for accommodation and financial support.
♦ Evidence of any cohabitation - eg, original or notarised copies of leases, utility bills, mail addressed to you both, joint bank accounts etc.
♦ Evidence of communication with your sponsor during any periods of separation - eg, letters, cards and envelopes, telephone bills, emails etc.
♦ Police check for all applicants aged 16 and over from all countries where the applicant has resided in the past 10 years (including Australia). Please refer to the Character Requirements paragraph on our FAQs.
♦ Form 80 Personal Particulars for Character Assessment.
♦ Australian National Police Check for sponsor of any applicants who are under 18 years of age.
♦ Medical Forms. Please refer to the Health Requirements paragraph on our FAQs.
If you are applying for a Prospective Marriage visa, please include all of the above, where applicable, and:
♦ A letter from a marriage celebrant in Australia specifying the exact date of the marriage and, in most cases, that a Notice of Intended Marriage has been lodged.
♦ Evidence that you have met in person (ie, photographs taken together etc).
Additional informaiton and/or documents may be requested once the application is assessed.
